Please read these terms carefully before using Passing Lane. By creating an account or using the app, you agree to be bound by these Terms of Service. If you do not agree, do not use the app.
Passing Lane is a California DMV permit test preparation application operated by Passing Lane Solutions LLC, a California single-member LLC ("Passing Lane," "we," "us," or "our"). The app provides practice questions, permit test simulations, a study guide, and related features to help California teens prepare for the DMV written permit test.
Passing Lane is not affiliated with, endorsed by, or operated by the California Department of Motor Vehicles. Passing Lane is an independent educational tool only.
You must be at least 13 years old to create an account and use Passing Lane. If you are under 18, your parent or legal guardian must review and agree to these Terms on your behalf. By using the app, you represent that you meet these requirements.
We do not knowingly permit users under 13 to create accounts. If we learn that an account belongs to a user under 13, we will terminate the account and delete associated data.
You must create an account to use most features of Passing Lane. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us promptly at hello@passinglane.app if you believe your account has been compromised.
Your username becomes your in-app identifier and is displayed on the leaderboard to friends you connect with. Choose a username that does not violate these Terms or the rights of others. We reserve the right to require a username change if it is offensive, misleading, or otherwise inappropriate.
You may not create more than one account per person or use another user's account without their permission.
You agree to use Passing Lane only for lawful purposes and in accordance with these Terms. You agree not to:
Passing Lane offers a one-time in-app purchase ("Unlock") that provides access to the full question bank beyond the free tier. All purchases are processed by Apple through the App Store and are subject to Apple's payment terms and policies.
The Unlock is a non-subscription, one-time payment tied to your Apple ID. It is not transferable to another Apple ID or account. All purchases are final. Refund requests must be submitted directly to Apple and are governed by Apple's refund policy. We do not process refunds directly.
We reserve the right to modify the features included in the free tier or the Unlock at any time with reasonable notice. If we materially reduce the features included in the Unlock, we will provide affected users with notice and a reasonable alternative.
Passing Lane practice questions are designed to reflect the material covered in the California Driver Handbook and the format of the DMV written permit test. However, we make no warranty that the questions, answers, or study content are complete, current, or perfectly accurate. The California DMV may update its test content, and our question bank may not always reflect the most recent changes.
Passing Lane is a study aid only. We do not guarantee that use of the app will result in passing the DMV written test. Passing the test is your responsibility and depends on your own preparation and performance.
The app and website contain links to third-party services, including driver's education providers, driving schools, and insurance comparison tools. These links are provided for your convenience and may generate affiliate revenue for Passing Lane. We do not endorse, control, or take responsibility for the content, practices, or terms of any third-party service. Your use of any third-party service is at your own risk and subject to that service's own terms and privacy policy.
All content in Passing Lane — including but not limited to the app design, question database, badge artwork, California plate designs, XP system, and marketing materials — is owned by Passing Lane Solutions LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the app for your personal, non-commercial use only. Nothing in these Terms grants you any rights to Passing Lane's intellectual property beyond this license.
When you submit a problem report through the in-app reporting feature, you grant us a non-exclusive, royalty-free license to use the content of that report to improve the app. Do not include personal information in problem reports beyond what is necessary to describe the issue.
Passing Lane is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of viruses or other harmful components.
To the fullest extent permitted by applicable law, Passing Lane Solutions LLC and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the app, including but not limited to loss of data, loss of progress, or failure to pass the DMV test. Our total liability to you for any claim arising from these Terms or your use of the app shall not exceed the amount you paid to us in the twelve months preceding the claim, or $10, whichever is greater.
You agree to indemnify and hold harmless Passing Lane Solutions LLC and its owner from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the app, your violation of these Terms, or your violation of any rights of a third party.
We reserve the right to suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or if continued provision of service is not technically or commercially viable. You may delete your account at any time by contacting us. Upon termination, your license to use the app ends immediately and we may delete your account data in accordance with our Privacy Policy.
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of Passing Lane shall be resolved in the state or federal courts located in Riverside County, California, and you consent to the personal jurisdiction of those courts.
Before initiating any legal proceeding, you agree to contact us at hello@passinglane.app and give us 30 days to attempt to resolve the dispute informally.
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will provide notice within the app. Continued use of Passing Lane after updated Terms are posted constitutes your acceptance of the updated Terms.
